Would these respected Democrats support an extremist? It is interesting how rarely Judge Kavanaugh’s critics name the specific cas- es on which they base their dubious accusations. Are they concerned the public might actually read them and find out his decisions are far less controversial than shrieking headlines might infer?Those who label this intelligent, fair-minded ju- rist as an ideological extremist actually expose their own extremism. Like Justice Kennedy for whom he clerked, I predict Judge Kavanaugh will be a swing vote. For all their bluster about preventing his confirmation,the Democrat leader- ship has very little chance of success.They need at least 51 votes to defeat him. This is unlikely unless they pick up two Senate seats in the midterm elections.Al- though they may take advantage of the Senate’s byzantine labyrinth of procedural rules trying to delay confirmation, the Republicans will ensure the matter comes to a vote before Nov. 6. The Democrat leadership knows this. So why do they continue this charade of fund-raising for this quixotic quest to defeat his confir- mation?Are they seriously ill-informed, or partisan charlatans seeking to separate the gullible from their money? Judge Kavanaugh fully supports judicial activism when it supports ruling for employers and the elite and against employees and real people. In Jackson v.Gonzales,496 F.3d 703,708 (2007) Judge Kavanaugh’s dissent- ing opinion credited the employer’s explanation that another employee was more qualified than the black employee suing for racial discrimination in promotion, based on experience the white employee had that was not even listed as needed in the job description. Kavanaugh said the Court should not second guess the employer’s subjective, belated assertions about an employee’s qualifications.This is a roadmap for employers to discriminate and get away with it. Defense attorneys that represent management in discrimination cases are elated over Kavanaugh’s nomination as he “goes the extra mile” for employers, he “looks for ways to rule for employers”, and “it will be an uphill battle for employees to win many cases, if he gets confirmed”, concluding that the “court will go from a reliably pro-business court to being solidly pro-business.”This is very frightening, especially for me, as I represent employees and victims of dis- crimination.
